1. Agreement to Terms
By accessing or using ChatGrid ("the Platform"), a product of ChatGrid (Pty) Ltd ("we", "us", or "our"), you agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and ChatGrid (Pty) Ltd, a company incorporated in the Republic of South Africa.
The Platform provides a WhatsApp AI Business Operating System designed to automate sales, support, bookings, and order management. Use of the Platform is also subject to our Privacy Policy and WhatsApp's Business Solution Terms.
2. Use of AI and WhatsApp
AI Disclaimer: ChatGrid utilizes advanced Artificial Intelligence (AI) to facilitate customer conversations. While we strive for accuracy, AI can occasionally generate incorrect information ("hallucinations"). ChatGrid does not guarantee the accuracy or reliability of AI-generated responses. You are responsible for supervising the AI's interactions with your customers.
WhatsApp Compliance: Users must comply with Meta's WhatsApp Business Policy. Spamming, unsolicited messaging, or any activity that leads to your WhatsApp number being banned is your sole responsibility. ChatGrid is not liable for account suspensions or bans by Meta.
3. Consumer Protection (CPA)
In compliance with the South African Consumer Protection Act (No. 68 of 2008), we ensure transparency in our pricing and service delivery. You have the right to cancel your subscription at any time, subject to our billing policy. Refunds are processed in accordance with the CPA's guidelines for digital services.
4. Payments and Billing
All pricing is listed in South African Rand (ZAR) unless stated otherwise. Subscriptions are billed in advance on a monthly or annual basis. Failure to pay will result in the suspension of access to the Platform.
Payments for customer orders facilitated through the Platform are processed via third-party payment gateways (e.g., PayFast, Yoco). We do not store full credit card details on our servers.
5. Limitation of Liability
To the maximum extent permitted by South African law, ChatGrid (Pty) Ltd shall not be liable for any indirect, incidental, or consequential damages resulting from the use of the Platform, including but not limited to loss of profits, data loss, or business interruption.
6. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the South African courts.
